The offer is perfectly valid.

I just got a free copy of Photoshop Elements from a friend of mine 2 days ago - he got it with his Wacom graphics tablet, doesn't use Elements, and I can now go and take advantage of that offer.

Not meeting the requirements of the offer doesn't mean the offer isn't valid :)

Get a copy of elements :)

If it costs you 50 bucks to buy a cheap graphics tablet with a free copy of elements, it's worth getting it to save $350 on the cost of Photoshop CS.

It's like saying "The offer is a dud, photoshop is only available for Mac & Windows, and I use Linux".
