Overriding HTTP 404 Status Header

For some reason or another the new server I'm on isn't letting me override the 404 HTTP status within the script I set as the 404 handler with an ErrorDocument directive. I've got a work around involving mod_rewrite that works fine, but I'd still like to know why it's happening. 
Strong with this one, the sudo is.
