IE been a pain - again

I am using a IE if so I can include the html5 shiv and it works, however it includes the if statmesnts but not the code on the website here is my code

Any clues on why its doing this (sory I don't have a live site to show you)
And before you ask its not IE9 its IE8... I think :oops:

this does that when it detects your ie version it launchs the correct way to view the site for that ie version. This also include IE9 version.
