help with DOCTYPE

Ok.. so I was trying to fix errors in respect to what the xhtml validation would have told me, except the fact that he doesnt detect my doctype. Can anyone tell me why is it doing that, here is my site:

The doc type looks fine. More than likely it doesn't like that you have a DIV prior to your HTML tags. i.e. your <!-- Panel -->

Thanks, I fixed it, I accidentally switched 2 .php includes between them, don't figure how i could skip on that :)) Anyway, thanks!
